Cedar Motors Limited (hereinafter referred to as “Dacia”) has created this site in order for you to obtain the latest information on Dacia products and services supplied by us and by the Dacia Dealer Network. We hope you enjoy using the site. Your access to and use of the site is conditional with your compliance to the terms and conditions set out below and all applicable legislation. These terms and conditions are to the exclusion of any other agreement made between you, Dacia or the Dacia Dealer Network regarding the use of this site. You agree that Dacia shall not be liable to you for any loss or damage to any property arising out of your failure to abide by your obligations hereunder.
Intellectual Property Rights
All rights of ownership in the site, illustrations, pictures, sound, script, animation and other material appearing belong to Dacia. All rights are strictly reserved. You shall not copy, amend, reproduce in any form whatsoever the information and material on the site or otherwise interfere with the site or do any act that is inconsistent with our rights. Passwords and Access Codes
During the registration procedure for our products and services, you must enter an account name and a password. You alone are responsible for keeping this account name and password confidential and for all the activities carried out on your account. Manufacturer’s Recommend Retail Prices - New Vehicles
Any prices stated are those taken from the latest recommended retail prices as recommended by the Renault Group as manufacturer described in the Car Price Guide ex Rosslare and include VAT & VRT.
All other products or services supplied by agreement between you and your dealer are not included. Please note that the "dealer asking price" or "windscreen price". It is not necessarily the price a consumer would actually pay, as it may be the subject of negotiation, discount or an extra allowance on the value of your own car. It will also vary depending on any special offers applicable at the time, condition, length of warranty and any options and extras that may be fitted.

Applicable Law
These terms and conditions shall be governed by and interpreted with Irish law. You agree to submit to the non-exclusive jurisdiction of the Irish courts in relation to any disputes which may arise relating to these terms and conditions.

Terms and conditions of use of the "Dacia Travel Companion" application
These Terms and Conditions of Use (hereinafter "TCU") govern access to and use of the mobile application “Dacia Travel Companion” (hereafter the “Application”) made available by RENAULT sas, whose registered office is located at 122-122 bis avenue du Général Leclerc - 92100 Boulogne-Billancourt, registered in the Nanterre Trade Register under number 780 129 987 (hereinafter "DACIA").
The TCU in force are those accessible by the User on the Application.
Article 1 - Definitions
"Application" refers to the "Dacia Travel Companion" mobile application published and provided by DACIA, giving access to the Services. The Application also includes the Contents, software, programs, tools (programming, navigation, etc.), databases, operating systems, documentation and all other elements and services that make it up, updates and new versions that may be made to the Application by DACIA.
"Content" refers to, but is not limited to, the structure of the Application, editorial content, articles, texts, drawings, illustrations, images, photographs, graphic charters, trademarks, logos, acronyms, corporate names, visual works, audiovisual works, multimedia works, visual content, audio and sound content, as well as any other content and/or element present on the Application.
"Services" refers to the various functionalities, connected and unconnected, accessible via the Application.
"User" refers to a DACIA prospect or current customer who has downloaded the Application for his/her own use, for strictly personal and non-commercial, non-profit, direct or indirect purposes.
Article 2 – Purpose of the Application
Dacia Travel Companion is a smartphone-based assistant capable of detecting driver drowsiness and recommending places to take a break at the right time. The application can be used to plan breaks on a car journey according to the driver's destination and number of hours of sleep.
It also features an algorithm capable of measuring the driver's drowsiness in real time, based on images from the smartphone's front camera.
Services available in the Application are as follows:
The list of Services is not exhaustive and may be modified at DACIA's discretion.
The Application uses the following Google API: a) Google Routes; b) Google Places and c) Google Maps.
The User is therefore informed that by using the Application he is also bound by the:

• Google Privacy Policy available at the following url: https://policies.google.com/privacy
Article 3 - Application download and prerequisites
3.1 Download
The Application is accessible on a compatible smartphone, equipped with Apple iOS 16 or Android 11 technologies , and with access to internet data. The ability to analyze the user's drowsiness depends on the smartphone's camera performance.
The Application can be downloaded from the Apple Store and Google Play Store platforms.
3.2 Activation
The User shall have created a My Dacia account in order to identify itself and use the Application.
The User is informed that the use of these functions requires an Internet connection, which may increase the amounts charged on the telephone service contract. DACIA is not responsible for any additional charges incurred on the telephone service contract or other amounts that may be charged for the use of the Application.
Downloading the Application and accessing the functions in the Application is free of charge.
Article 4 – License of use
DACIA grants the User a personal, non-exclusive, revocable, non-transferable, unlimited and free right to use the Application, the Contents and the Services solely for its own needs in connection with the Use of the Application and the Services, to the exclusion of any other purpose.
The User is strictly prohibited from accessing, decompiling and/or using the software components of the Application.
The User acquires no rights to the Application, the Content and/or the Services other than those granted strictly within the framework of the present contract.
Article 5 – Obligations of the User

Depending on the User's agreement to collect their geolocation data and/or to access their telephone contacts, access to certain features may be restricted.
DACIA undertakes to do its utmost to ensure secure access, consultation, and use of the Application. This is an obligation of means, entered in consideration of technical hazards, so that under no circumstances can the Application guarantee continuous use without disruption.
The Application is always accessible, but may be subject to interruption, suspension or modification. Access to the Application may be interrupted or suspended in the event of force majeure, the occurrence of an event beyond DACIA's control, and any breakdowns and maintenance operations necessary for its proper operation. The availability of the Application may also be interrupted in the event of intrusion, piracy, malfunction, breakdowns and constraints linked to the operation of networks or requests from authorized public authorities.
Article 7 – Liability
To the extent permitted by applicable laws and regulations, DACIA declines all liability for the use of the Application by the User and gives no warranty, express or implied, as to the speed and/or performance of the Application or as to the use made by the User of the data and/or information accessible via the Application, or as to the compatibility of the Services for any particular use. In particular, DACIA does not guarantee that the Application will be free of errors, defects or omissions, nor that it will not be subject to damage or attacks, in particular viruses, that could lead to malfunctions, service interruptions, breakdowns or losses of data or information. Access to the Application may be temporarily and periodically suspended for technical reasons, which the technical teams will endeavour to resolve as quickly as possible.
Access to and use of the Application are at the User's own risk. The User is responsible for taking all appropriate measures to protect his/her own data and/or software stored on his/her cell phone and tablet against any intrusion or violation.
DACIA does not guarantee that the Application will detect all forms of drowsiness under all conditions. The Application complies with French road safety recommendations, and suggests a 15-20 min break at a maximum frequency of two hours.
In any case, DACIA will be exonerated from all responsibility:
in the event of non-compliance by the User with these TCU;
in the event of malfunction of the Application due to a cause, whether voluntary or involuntary, attributable to the User or to a third party or resulting from a malicious act, resulting from the malfunction of software, smartphone, tablet PC or any other interface/product belonging to the User;
in the event of malfunction of the Application due to a cause, whether voluntary or involuntary, attributable to the User or to a third party or resulting from a malicious act, resulting from the malfunction of software, smartphone, tablet PC or any other interface/product belonging to the User;
in the event of malfunction and/or failure of the User's communication network, whatever the cause;
in the event of direct or indirect damage resulting from the use of the Application, in particular while driving;
in the event of legislative or regulatory changes affecting the Application;
in the event of downloading by the User which is contrary to public order or morality, or in violation of any of the above restrictions;
in the event of non-compliance with the conditions of use specific to applications and/or sites published by third parties, or of any non-performance or partial performance of obligations by third-party publishers.
DACIA cannot be held responsible for the content (most specifically text, videos, images, photographs, etc.) and/or products and/or services offered by applications and/or sites published by third parties, all of which are the sole responsibility of said third-party publishers.
Article 8 – Personal data
As part of the use of this Application, the Users' personal data are processed to provide, in whole or in part, the services set out in Article 2 of these Terms and Conditions of Use. To enable the User to access the Application, DACIA collects identification data via the ID Connect process.
When planning their trip, the User may share their geolocation data with the navigation application provider among the three offered, namely Waze, Google Maps, and Apple Maps. In these circumstances, the User is informed that the provision of the navigation service requires the processing of personal data by third parties. If the User uses the application offered by these third parties, they must refer to the corresponding personal data protection policy and, if necessary, exercise their rights with them.
Furthermore, to suggest driving breaks based on the trip, the User, if he wishes, can share their sleep data with DACIA:
• already recorded in third-party health applications Apple Health Kit and/or Google Health Connect, downloaded to their smartphone or,
• entered manually in the settings provided for this purpose in the Application.
Additionally, the User also has the option to activate the front camera of their smartphone, so that their state can be evaluated in real-time.
All data from the front camera, third-party health applications, and/or manually entered sleep data are analyzed only locally on the User's smartphone. The data does not leave the smartphone and are kept for a maximum of twenty-four (24) hours.

Article 9 – Intellectual property
The Application and its Contents, and the Vehicle models are protected by intellectual property rights and are the property of DACIA or of third parties having authorized DACIA to use them. Any reproduction, representation, use, adaptation or modification, by any process whatsoever and on any medium whatsoever, of all or part of the Application and/or the Contents and/or the Vehicle models, without having obtained the prior authorization of DACIA, is strictly prohibited and constitutes an infringement.
DACIA, vehicle model names, slogans and, in general, the trademarks displayed on the Application are registered trademarks of DACIA and remain its property. Third-party trademarks on the Application remain the property of those third parties who have authorized DACIA to reproduce and use them. Their reproduction, either identically or by imitation, or their use without the prior authorization of DACIA or their respective owners is strictly forbidden and constitutes an infringement.
The User may not copy, modify, reproduce, represent, translate in whole or in part, in any form whatsoever, the information and elements appearing on the Services, nor intervene in the Services, nor act in such a way as to infringe the intellectual property rights of DACIA and third parties who have authorized DACIA to use them.
In general, the User acquires no property rights of any kind whatsoever, on know-how, corporate names, trade names, trademarks, copyrights, logos, patents and any other intellectual property rights related to DACIA.
Article 10 – TCU update
The TCU applicable are those in force at the date of connection and use of the Application by the User. DACIA reserves the right to modify and update these TCU without notice, at any time and without prior notice to Users. Where applicable, modifications and updates will be binding on the User as soon as they are published on the Application, and the User is responsible for consulting the current TCU at each connection.
Article 11 - Applicable law
These TCU and all rights and obligations arising out of or in connection with the use of the Application shall be governed by and construed and enforced in accordance with the laws of France. Any dispute relating to access to and use of the Application must be settled amicably between the parties before being submitted to the Courts of the jurisdiction of Nanterre, to which the parties attribute exclusive jurisdiction, notwithstanding multiple defendants or claims for compensation from third parties.
Article 12 - Miscellaneous
No waiver
The fact that one of the parties does not invoke a clause of the present TCU must not be interpreted as a temporary, nor a fortiori definitive, renunciation of the benefit of the said provision, which will remain in force.
Nullity of a clause
If one or more provisions of these TCU are declared invalid, void or unwritten by virtue of applicable regulations, amendments or as a result of a final decision by a competent court, the other provisions shall remain in full force and effect.
Force Majeure
DACIA may not be held liable for any event that constitutes force majeure and results in malfunction of the Application.
The following are expressly considered to be cases of force majeure, in addition to those usually accepted by applicable national case law: governmental and legal restrictions and modifications, computer breakdowns and telecommunications blockages as well as server breakdowns, Internet network failures or computer malfunctions ("bugs", viruses, malware, intrusions).
